a. These conditions shall overwrite any previous conditions made by the company “Natural Company Ltd”

2. DEFINITIONS

a. The “company” is “Natural Collagen Ltd” registered in England, Company No: 5232896 on 16th September 2004. Registered address: 19 Moulton Park Office Village, Scirocco Close, Northampton, NN3 6AP, UK.

b. “Trading address” is 9 Roods Close, Sutton In Ashfield, Nottinghamshire, NG17 1NL.

c. The “Manufacture” is PureLogicol International Ltd.

d. “Customer”, “Retail Customer” or “Trade Customer” is the person, business or company who purchases or agrees to purchase “the goods” from Natural Collagen Ltd

e. “Trade Customer” is a Customer who is in a position of business enabling them to retail goods supplied to their Customers. Natural Collagen shall not supply goods at trade discount unless suitable evidence of business has been evidenced. Trade Customers purchase goods from Natural Collagen Ltd on the understanding that they do not act as distributors/wholesalers themselves, without express permission from the Managing Director of Natural Collagen Ltd in writing.

f. “The Goods” are the purchased products or products displayed for sale on any site owned by the company “Natural Collagen Ltd”

g. “The Basket” shall be the virtual shopping basket and checkout.

h. “The order” shall be any order placed by the Customer with Natural Collagen Ltd for the Supply of Goods by means of online payment systems, telephone ordering or by any other recognised means acceptable to Natural Collagen Ltd.

i. “Customers Credit Card” shall be the Customers debit or credit card to be used as the payment means for the Goods which the Customer has provided details to Natural Collagen Ltd when placing an order.

j. “The Website” shall be Natural Collagen Ltd’s Virtual online shopping areas.

3. PAYMENT

a. Payment is required prior to dispatch otherwise if acceptable to Natural Collagen Ltd terms will allow “Trade Customer” to have 30 days credit.

b. Payment shall be cleared funds beit from credit, debit cards, cheque or cash.

c. Terms of 30 day credit shall be authorised on evidence of good credit management through credit checks with previous or current creditors. Natural Collagen Ltd shall in some cases refer to credit reference agencies. Natural Collagen Ltd reserves the right to change credit limits with 7 days notice without any given reason.

d. Failure to adhere to cleared funds being received by the end of the 30th day of credit may result in penalties listed by The Late Payment of Commercial Debts (Interest) Act 1998, which states that after the 30th day Natural Collagen Ltd can add interest to the debt at the current Bank of England base rate + Current Statutory Rate of 8%, daily.

e. Failure to pay overdue debts and penalties mentioned in item 3.d by 60 days will result in termination of “Trade Customer” relationship and given discounts with Natural Collagen Ltd.

f. Failure to pay overdue debts and penalties mentioned in item 3.d by 90 days will result in the account being handed to a Debt Collection agency chosen by Natural Collagen Ltd.

g. 30 Day Credit terms shall only be given to invoices with a maximum value of £500. Invoices of £500.01or more will require a deposit of cleared funds as shown on the scales listed in item 3.h. before any Goods are dispatched.

h. £500.01 to £1000 deposit required 15%, £1000.01 to £1500 deposit required 30%. Invoices £2000.01 or more require a minimum 50% deposit.

4. DELIVERY

a. All Goods purchased via Natural Collagen Ltd by Retail Customers are delivered within the UK completely free of charge using the Royal Mail. Retail orders are usually delivered between 5 and 7 days.

b. Natural Collagen Ltd reserves the right to despatch by the least expensive method where a charge for delivery is not being made

c. Trade Customers will pay for postage on all orders under £500. Postage paid will cover insurance on the Goods during transit.

d. Trade Customers orders that are £500 or over, or weigh less than 10kg, including packaging, will not pay postage.

e. Natural Collagen Ltd will use the minimum postage service requiring a signature on delivery, for all Trade Orders.

f. Natural Collagen Ltd delivers products to European/Worldwide destinations by Airmail with 'International Signed For' confirmation. We will do our utmost to make sure products are packaged and labelled accurately, however Natural Collagen Ltd will not be able to accept any responsibility for products that go missing or that arrive in a damaged state.

g. Goods supplied by Natural Collagen Ltd are delivered at the risk of Natural Collagen Ltd. Customers who find that the Goods arrive in damaged or unsatisfactory condition must inform Natural Collagen Ltd in writing within 3 days of receipt and return the Goods to us within 7 days.

h. No claim for loss/ damage or refund will be allowed if the Customer claims outside the time limit mentioned on item 4.g.

i. All refunds/replacements will be sent from 14 days of receipt of Goods. Refunds will be sent by original payment method. Cheques will be made in UK Sterling only, drawn from a UK Bank.

j. Customer who do not receive their Goods within 14 days from dispatch date should notify Natural Collagen Ltd. If Natural Collagen Ltd are unable to locate the Goods, a replacement order will be sent.

k. Retail Customers have 7 days to cancel the order and a full refund will be sent within 7days of cancellation by original payment method.

5. FORCE MAJEURE

a. Natural Collagen Ltd shall have no liability to the Customer for any goods supplied that are damaged, unsatisfactory or undelivered which is caused by any event or circumstance beyond Natural Collagen Ltd’s reasonable control. This includes strikes, lockouts and other industrial disputes without limitation. The list is only a representative sample of events.

6. DATA PROTECTION

a. Natural Collagen Ltd has a firm commitment to the privacy of any Customer we have a relationship with. Natural Collagen Ltd receives Customer information acquired through enquiries/orders and marketing methods. Natural Collagen Ltd will not offer any customer Database under their management for rent or resale. All contents of such Databases are strictly confidential and will be used to contact the Customer about Goods or Services offered by Natural Collagen Ltd only. Natural Collagen Ltd offer the Customer to Opt-Out of any database held ourselves. This can be done by contacting Natural Collagen Ltd via removeme@natural-collagen.co.uk or by writing to us at trading address listed at item 2.b

7. COPYRIGHT

a. All Goods or other Descriptions/images used by Natural Collagen Ltd remain the copyright of either Natural Collagen Ltd or the Manufacturer. Express permission is required in writing, before any use of such Goods or other Descriptions/Images be used by any third party.

8. MEDICAL DISCLAIMER

a. All descriptions of Goods by Natural Collagen Ltd beit by website description/advice via email or telephone should only be used as a guide. Proper professional medical advice should be sought in all cases if the Customer intends to use the Goods for any pre-existing medical condition. Natural Collagen Ltd recommend that anyone with a medical condition, who is pregnant or lactating and children under 12 should consult their Medical Practitioner or Therapist before taking or purchasing any Goods supplied by Natural Collagen Ltd.

9. LIABILTY

a. Nothing in these terms shall affect the Customers Statutory Rights as a consumer, nor are terms intended to do so. Natural Collagen Ltd will accept liability for fraudulent misrepresentation or for death or personal injury resulting from Natural Collagen Ltd’s direct negligence. Natural Collagen shall not be liable to the Customer for any indirect, special or consequential loss or damage whether for loss/profit or otherwise, which arises from the resale or supply of the Goods by the Customer. Natural Collagen Ltd will accept no liability once the Goods have been accepted by the Customers as their own.

10. MISCELLANEOUS

a. Natural Collagen Ltd reserves the right to change any part of these terms. Natural Collagen Ltd will endeavour where applicable to notify Customers of any changes which may affect them directly.
